Speaking of the FTC...oh, wait, we haven't introduced them in this newsletter yet...okay scroll down and read the news and then come back to this section...
Anyway, the FTC. They've spent the past year cracking down on healthcare companies for sloppy data-handling practices. And the question everyone always wants to know is, "why does the FTC have power over healthcare organiations?"
The short answer is that the FTC is responsible for protecting data privacy for all consumers, regardless of industry. But in healthcare, it comes down to two pieces of legislation:
The FTC Act - prohibits companies from engaging in unfair acts or practices with data.
The Health Breach Notification Rule (HBNR) - requires vendors of personal health records, related entities, and third-party service providers to notify consumers, the FTC, and potentially the media if there’s a data breach involving unsecured health information.
A not-so-fun-fact about HBNR: The term “breach” might remind you of cyberattacks or employee negligence. But the HBNR also covers the unauthorized transfer of data to third-party platforms like Google and Meta.
That headline is quite a mouthful. But this report is timely as lawmakers are considering new regulations to protect consumer privacy.
Here's the need-to-knows from the report: Social media and video streaming companies collect and monetize vast amounts of personal data, generating billions annually.
These practices pose significant privacy risks, threaten freedoms, and can potentially lead to significant consumer harm. The lack of protection for kids and teens is particularly concerning, and the findings are timely as lawmakers consider new regulations to curb abusive data practices.
