I spent a few days in Texas earlier this week to catch the path of totality for the solar eclipse. I've seen eclipses before. In 2017, I was at about 90% totality. But 100% totality was completely different...better than I expected. Just an awe-inspiring experience.
It's a loooong wait until the next eclipse in the US, but you should save the date anyway. It's worth the experience if you haven't done it.
Anyway, let's get into this week's newsletter. We've got a product update about LinkedIn, plenty of events to talk about, an article from Invoca, and new news about the number of healthcare orgs still using Meta's pixel.
Let's get to it...
Product Update
Further down this newsletter, you'll see that healthcare organizations are still using LinkedIn's tracking technology on their websites. That tool, like other trackers, could lead to HIPAA violations and lawsuits.
And that's exactly why Freshpaint just built an integration with LinkedIn. You can now govern data flowing to LinkedIn with our integration. That means you can prevent PHI from ending up in a non-BAA-protected platform.

Freshpaint's Compliant Corner
Late last month, HHS updated its guidance about the use of online tracking technologies. There was a lot in this update, so we joined forces with our friends at Invoca to write a straightforward summary of the changes you need to know.
Among other things, HHS clarified:
Unauthenticated pages can risk HIPAA compliance
Consent managers do not replace written HIPAA authorization
IP addresses alone are not PHI on unauthenticated pages
A recent analysis of healthcare websites found that 33% of them are still using Meta's tracking pixel. I'll repeat that:
One-third of healthcare websites are still using Meta's tracking pixel.
Meta's pixel isn't in a gray area. It definitely collects PHI, which is a HIPAA violation. But that wasn't the only tracking technology found in this analysis.
The researchers also found healthcare organizations were still using trackers from Google (googletagmanager.com, doubleclick.net, google-analytics.com, google.com, googleapis.com, youtube.com), Meta (facebook.com, facebook.net), ICDN (icdn.com), and Microsoft (linkedin.com).
