HIPAA may be the healthcare industry’s baseline for privacy, but it’s not the only thing you should anchor your compliance efforts on. A growing wave of lawsuits and FTC enforcement actions are targeting health organizations for tracking tech like pixels and cookies, even when HIPAA doesn’t technically apply.
Plaintiffs are using creative legal strategies, from wiretapping laws to the Video Privacy Protection Act, to sue not just hospitals, but also payors and insurers. All it takes is a browser extension and evidence that sensitive behavioral data is being shared without proper consent.

Industry News: App Data Poses Privacy Risks
A new report from our friends across the pond. Cambridge is sounding the alarm on apps that collect a lot of health data, like menstrual tracking apps.
Researchers found that popular menstrual and fertility tracking apps are leaking deeply personal health data -- including sexual activity, symptoms, and pregnancy history -- to advertisers. This data is often shared via third-party trackers without users’ meaningful consent. Sound familiar?
The concern isn’t just about creepy ad targeting. Experts warn that in the wrong hands, this data could pose real safety risks, especially for people in places where reproductive healthcare is restricted or criminalized. The report urges U.S. regulators to treat this data with the same legal protections as other sensitive health information and calls for tighter enforcement of existing privacy laws.
