The AHA’s lawsuit against HHS’s December 2022 guidance has been a hot topic for the past few months. Judge Pittman’s ruling on the lawsuit back in June seemingly created more confusion rather than clearing anything up.
The big takeaway is this: The ruling affects IP addresses and health information on public sites. That’s it. And that’s only a small part of HHS’s December 2022 guidance. Judge Pittman’s ruling does not negate the broader privacy risks of tracking technologies on healthcare websites.

Inflation has hit HHS. Or at least the monetary penalties for HIPAA violations. In December of last year, the Office of Management and Budget set its annual inflation multiplier for all government agencies.
According to The HIPAA Journal, HHS was supposed to apply the adjustment by January 15th. But HHS plays by their own rules and only very applied the inflation multiplier last week.
With this inflation multiplier, the maximum civil monetary penalty (CMP) amounts for HIPAA violations is now $2,134,831.
