Freshpaint 5 Header FINAL

Hey there,

This tweet is a few years old, but feels extremely relevant for me right now:

one day you're young, hip, and carefree and the next you're in a work call hearing yourself say that “there are a lot of moving pieces”

I used to be the guy who was firmly anti-corporate jargon. Now I catch myself dropping allll the clichés -- “let's circle back,” “it's a bandwidth issue,” “lots of moving pieces” -- without even thinking. Anyone else feeling that? Just me?

Anyway, while I try to figure out who I am, here's what I've got for you in this week's newsletter:

  • Post-sync monitoring
  • Hang out with us in Dallas
  • Agencies: tune into our upcoming webinar
  • Consent tools
  • The latest $18M settlement

Let's get to it...

Product Update: Post-Sync Monitoring

When you upload an audience to Meta or Google, the waiting game begins. Those platforms can take up to 48 hours to process your data. And until now, they’ve given you almost zero visibility into what’s happening in the meantime.

We're fixing that. Our new post-sync monitoring view shows you the status of every audience upload across platforms -- queued, processing, completed, or failed -- all in one place.

Why it matters:

  • Ad platforms keep you in the dark; Freshpaint brings the visibility.

  • Track progress in real-time instead of guessing when your audience will be ready.

  • Especially critical for time-sensitive campaigns or troubleshooting delivery issues.

If you're already using Audiences, you can login to Freshpaint to see it now!

Fresh Content: Consent Tools

A cookie banner isn’t enough.

Consent Management Platforms (CMPs) do a solid job of recording and storing patient consent preferences. But here’s the catch: they don’t actually enforce those preferences across your marketing stack. Which means pixels and trackers can still fire. Even when a patient has opted out.

Freshpaint closes that gap. By integrating directly with CMPs like OneTrust and Osano (or via our Consent Manager API), Freshpaint makes patient consent actionable:

  • Block tracking by default until consent is collected

  • Enforce preferences across GA, Google Ads, Meta, and more

  • Monitor all site trackers to see what’s firing and when

The result? Clearer compliance with laws like CCPA and NYCPA. And more importantly, a foundation of trust with your patients.

What's Got Our Attention: $18M settlement

A few things top of mind for us this week:

  • Tracking Technology Trends and Risk Mitigation Techniques: Wiretapping lawsuits and regulatory crackdowns on tracking tech like pixels and chatbots are accelerating, with California alone seeing 1,800+ cases since 2022.
  • Nonprofit health system agrees to $18M settlement over use of ad trackers: An Ohio nonprofit hospital agreed to a $17.8M settlement after ad trackers embedded in its patient portal allegedly exposed data from 89,000 patients to third parties like Meta and Google.
  • Oracle, Silver Lake consortium to control 80% stake in TikTok in US, WSJ reports: Not directly healthcare-related, but notable for marketers: TikTok’s U.S. operations will move under a new company with 80% U.S. investor control (Oracle, Silver Lake, Andreessen Horowitz), with Oracle overseeing U.S. user data under government oversight.

That's all for this week. Catch you next week!
