Freshpaint 5 Header FINAL

Hey there,

I've said this before, but I love bad spam emails. Case in point...I got one this week from “Sebastian” that read:

"I noticed your competitors appear to be converting the traffic you should be getting for ‘best painting in my area’ on Google. I can dive into why…and map out how to beat them if you’re interested."

Pretty clear Sebastian didn’t spend a second on our website. Best painting in my area?? Not only is that keyword completely irrelevant to what we do, but I guarantee none of our competitors rank for it either.

Props to him, though -- at least he’s not using AI. AI would've gotten closer than that.

Anyway, while I'm busy figuring out how to make us the #1 “best painting” company, here’s what I’ve got for you this week:

  • A new navigation update
  • Yacht Dinner in Chicago...I'm on a boat!
  • Cookie consent
  • The latest $5.2 million class action settlement

Let's dive in...

Product Update: Ctrl-K

You asked for faster navigation in our Healthcare Privacy Platform, and we delivered. You can now hit Ctrl-K (or ⌘-K on Mac) to open a sleek new command bar and instantly jump to any page across the platform.

  • Why it matters: With our updated navigation, this makes it way easier to find what you need. No more clicking around. Plus, it just looks slick.
  • Who benefits: Everyone. Whether you're in Freshpaint daily or still learning your way around, Ctrl-K is your new best friend.

Oh, and if this seems like a minor update...it's because something BIG is coming. Our team has been working heads down, building the future of healthcare marketing. And next week, we're pulling back the curtain.

You won't want to miss it.

Tracking in Healthcare Marketing: Why Payers Are Rethinking Privacy Risk

On-Demand Webinar

A cookie banner won't save you.

Healthcare marketers often assume a consent management platform (CMP) equals compliance, but that's a dangerous myth. Most CMPs record preferences but don’t actually stop data from leaking, leaving organizations exposed to overlapping state, federal, and FTC rules.

Our latest blog takes a hard look at why CMPs fall short under today's patchwork of privacy laws. From California's CPRA to Washington's MHMDA, to HIPAA, HBNR, and state wiretapping laws, marketers face overlapping obligations that stack penalties for even "accidental" data leaks. The blog breaks down the four biggest risk areas where CMPs fail:

  1. Consent and Opt-Out Enforcement – trackers still fire despite opt-outs or GPC signals.
  2. Unauthorized Health Data Sharing – CMPs don’t meet HIPAA/MHMDA consent standards.
  3. Interception of User Communication – some session replay tools and pixels load before consent is even processed.
  4. Deception & Breach Exposure – disclosures often don't match actual practices.

The takeaway? A CMP alone is just a neon "No Trespassing" sign over an open gate. Real compliance means blocking unauthorized trackers before they load, enforcing BAAs, stripping sensitive data at the data layer, and continuously auditing what actually leaves your site.

What's Got Our Attention: $5.2M

Mount Sinai Health System has agreed to pay $5.2 million to settle a class action lawsuit over its use of the Meta pixel, which allegedly shared patient information with Facebook.

This is the 24th enforcement action against healthcare organizations this year tied to marketing technologies -- a clear signal that regulators and plaintiffs’ attorneys are not slowing down.

And as we just covered in a webinar today, healthcare organizations are already feeling the squeeze from budget pressures. Adding multimillion-dollar settlements to the mix? That’s the kind of "line item" you could avoid just by building a strong privacy foundation before launching marketing campaigns.
