Fall/autumn seems to be everyone's favorite season...but they're all wrong. Spring is objectively better. There's a positivity in the air during Spring. The days are longer,  baseball season starts, warm weather hobbies return, and people are just happier.

 

How is Fall better than any of that? It's not. And if you disagree, you can find the unsubscribe button at the bottom of this email (kidding, kidding, please don't unsubscribe. My boss, Ray, wouldn't be happy if I prompted a bunch of people to unsubscribe).

A key part of HHS's updated guidance (more on that below) is your ability to get a Business Associate Agreement (BAA) with a martech vendor. The obvious question is, "which tools do you need a BAA with?"

 

The easy answer is, "any tool that collects PHI," but it's hard to tell which tools that fall into that category. 

 

To help, we wrote an article that identifies which tools you need a BAA with, and the tools you just can't get a BAA with. 

 

In general, you need a BAA with: CRMs, analytics tools, email marketing tools, personalization tools, form building tools, identity resolution tools, and SMS tools. 

 

That's a starting point, but there are others.

Industry News

 

I mentioned this last week, but it's extremely important so I'm going to bring it up again...

 

HHS updated its guidance about the use of online tracking technologies last week. There were a few big updates in this version of the guidance:

  1. Unauthenticated pages can be a risk for HIPAA compliance
  2. Consent managers do not replace written HIPAA authorization
  3. IP addresses are not PHI by themselves on unauthenticated web pages
  4. Removing PHI from the data a non-compliant tracker receives is not enough
  5. HHS approves using CDPs like Freshpaint

Those five updates should actually improve things for healthcare marketers. They provide a clear path forward for balancing high-performance marketing and HIPAA compliance.
