Freshpaint 5 Header FINAL

Hey there,

I almost let one of the year's most important holidays slip by unnoticed. Almost. Thankfully, Freshpaint's Sr. Content Production Manager, Ronnie, reminded me that today is National Solitaire Day!

Naturally, I'll be celebrating the only way that makes sense: spending the rest of my workday chasing that glorious cascade of victory cards. (Just don't tell my boss. If anyone asks, I'm "deep in strategic planning." That sounds legit… right?)

Before I go any further into today's newsletter, our healthcare marketing virtual monthly meetup is happening in, like, 15 minutes. It's going to be a good one. Healthcare attorneys Jen Pike and Jennifer Everett from Alston & Bird will be joining us to answer your questions on compliance and regulations.

Get the details and sign up here.

And here’s what else I've got for you today:

  • An ask for any medical device marketers
  • Come hang out with us in person!
  • Learn how Priority Health solved privacy compliance
  • Covered California screwed up big time

Let's dive in...

Med Device Experts Needed!

We're on a mission to better understand how medical device marketers actually do their jobs. Because let's be honest: if our product and messaging don't reflect the real world, we're not doing our job right.

If you're in the med device space, or know someone who is, we'd love to chat. We're looking to learn more about how you think about things like direct-to-patient marketing, compliance, and where the biggest gaps are today.

Super informal. 30 minutes. We’ll send you a thank-you gift card.

Reply to this email to let me know if you're interested (or feel free to forward it to someone who might be)!

Tracking in Healthcare Marketing: Why Payers Are Rethinking Privacy Risk

On-Demand Webinar

In this on-demand webinar, legal and marketing experts break down the latest regulations targeting pixels and cookies in healthcare marketing — and share actionable strategies to help payers stay compliant without compromising digital performance.

Freshpaint's Compliant Corner

We recently partnered with Amsive to tell the story of Priority Health's privacy journey. It went a little like this...

After the 2022 OCR guidance rendered most ad tracking tools noncompliant, Priority Health abruptly disabled all third-party pixels, leaving its marketing team blind to campaign performance.

The solution? A strategic partnership with Freshpaint to implement a privacy-first marketing that restored analytics without compromising patient privacy.

Key takeaways:

  • HIPAA didn’t kill performance. It just changed the rules. Privacy CDPs like Freshpaint help marketers rebuild compliant measurement systems.
  • Cross-functional alignment is essential. Success required navigating finance, legal, compliance, and procurement with data-backed business cases.
  • The result: Priority Health is now building a new performance benchmark while protecting PHI across its digital campaigns.

Industry News

The Markup just revealed that California's state-run health insurance marketplace, Covered California, was sending visitors' personal health information to LinkedIn.

Yep, LinkedIn.

The breach happened through LinkedIn's Insight Tag, which was embedded on Covered California’s site. The tag passed sensitive info like users' IP addresses, estimated household income, and the fact that they were shopping for health insurance, to LinkedIn.

This information was being shared as part of LinkedIn’s “conversion tracking” and ad retargeting systems.

While Covered California says the tracking was "unintentional," the real story here is how easy it is for this kind of thing to happen, and how hard it is to detect.
