Canadians celebrate Thanksgiving in October. We should too.

Freshpaint 5 Header FINAL

Hey there,

I’m a few days late, but I want to wish our friends north of the border a Happy Thanksgiving. In case you missed it, Monday was Canadian Thanksgiving. And to be honest, I’m a little jealous they get to celebrate it so early. We have to wait another six weeks.

That’s a long time.

So to solve this problem, I’m starting a petition for the US to celebrate Canadian Thanksgiving in addition to our regular Thanksgiving.

Who says no? That’s an extra day off work. An extra good meal. An extra round of hearing your uncle ramble on about his bizarre political leanings.

I’m sold. And in the spirit of giving thanks, I’m thankful for these topics in today’s newsletter (what a great transition):

  • An update to Freshpaint's Web Tracker Monitoring
  • What we're doing in LA next week
  • A deep dive into state-level privacy laws
  • A data breach tracker

Let's get into it...

Product Update

We sneak-peeked it last week, but this week it's official:

🎉 Web Tracker Monitoring now has historical insights 🎉

This latest enhancement includes a color-coded dashboard that makes it easy to track your web trackers risks over time. These insights can be shared with your compliance and leadership teams to demonstrate progress toward compliance.

Everything will be accessible from your WTM dashboard next week, and you can download reports as spreadsheets for further analysis.

Freshpaint's Compliant Corner

It’s obviously not a secret that a presidential election is coming up.

But that’s almost irrelevant when it comes to privacy laws because privacy may be the only true bipartisan issue. We see this play out at the state level, with both red and blue states enacting tough data privacy laws that affect healthcare.

These laws cover more data than HIPAA does, which makes them particularly interesting for healthcare marketers.

In a recent webinar, Jennifer Pike, a healthcare lawyer at Alston & Bird, took us through a deep dive of state-level privacy laws. And because we know you’re busy, we created a 6-minute clip of Jennifer’s dive into state-level privacy laws.

Watch it here: How are state level privacy laws addressing gaps in health data protection?

Industry News

It's been a slow week for industry news. But data breaches in healthcare haven't been slow, and it's a good time to revisit them. According to Healthcare Dive, "Healthcare data breaches are on the rise as companies increasingly use digital services to store sensitive patient material."

Now, when most people think of a data breach, they think of hackers and cyber-attacks. But that's not the only type of data breach.

There are other types of data breaches, like when a healthcare organization impermissibly shares data with an ad platform like Facebook or Google -- an action that happens easily with pixels, tags, and trackers.

HHS clearly states that sharing data with those third parties is a breach: "A breach is, generally, an impermissible use or disclosure under the Privacy Rule that compromises the security or privacy of the protected health information."

For more on data breaches, Healthcare Dive has a data breach tracker: Tracking healthcare data breaches

Thanks for reading, see you next week!
