Freshpaint 5 Header FINAL

Hey there,

I have a confession to make: I worked about three hours today under the firm belief that it was Wednesday, which created a big problem.

Every Wednesday afternoon, I carve out an hour to plan this newsletter. So imagine my surprise when my first meeting of the day began with someone casually mentioning that today is actually...Thursday.

Cue the panic: I hadn't planned a single thing for this issue. That's the gift and curse of a shortened week after Memorial Day...it moves fast, but maybe too fast.

So we're shooting from the hip today. Whatever pops into my head is going in. Will that get me in trouble? Maybe! But let’s find out together.

Here's what I'm covering today:

  • An Ad Performance Update
  • Dinner on us in NYC
  • The digital transformation in healthcare
  • Privacy lawsuits from 2022 finally settled

Let's dive in...

Freshpaint's Compliant Corner

Healthcare organizations are quickly shifting ad budgets from traditional channels to digital. We've heard of systems pulling spend from stadium sponsorships and reinvesting it into Meta ads. But doing it wrong could land you in hot water.

That's why we wrote the eBook From Billboards to Clicks. It unpacks why privacy-first strategies are now non-negotiable.

With growing HIPAA scrutiny and new state privacy laws, old habits like using Google Analytics or Meta Pixels are no longer compliant. The best path forward is to replace risky trackers with a privacy-safe infrastructure that still delivers full-funnel visibility, from ad click to attended appointment, without compromising patient data.

The result? Marketers can finally optimize spend, prove ROI, and stay compliant. As one marketer puts it: "You can’t improve digital marketing without taking care of the privacy aspects first.”

Industry News

If you've been following the Meta pixel lawsuit news over the years, you might remember WakeMed and Duke Health getting hit with class action lawsuits over pixel usage back in 2022.

Well, good news (or maybe it’s bad news?), we finally have closure on those lawsuits. They ended in settlements. Big ones.

With WakeMed agreeing to pay $2.5M and Duke Health paying $3.7M. These settlements send a clear message: if you're still using third-party pixels, you're playing with fire. It’s another wake-up call for healthcare marketers to consider a privacy-first approach.
